        <![CDATA[<p>Earlier this month a crane in New York City, doing work on the No. 7 subway line extension, collapsed. One worker lost his life as a result of the accident. The tragedy has now prompted officials to tighten crane operator safety regulations.</p>
<p>In hopes of preventing similar <a href="http://www.djhernandez.com/Workplace-Injuries/Crane-Accidents.shtml">New York City crane accidents</a>, it was announced yesterday that crane operators must now comply with additional regulations to be fully licensed. Crane operators will be required to take a 40-hour training course and pass a national certification exam.</p>]]>
        <![CDATA[<p>Currently, a test for crane operators is administered by the city. By requiring crane operators to be nationally certified New York is working towards compliance with a federal mandate, which requires crane operators be certified through accredited agencies by 2014.</p>
<p>In 2008, the city began strengthening licensing regulations after two crane collapses took the lives of nine people. "Crane accidents in New York and other cities in recent years have showed us all that more oversight is needed over this industry, not less," explained the Buildings Commissioner whose agency handles crane inspections and the licensing of operators.</p>
<p>The crane operators' union, the International Union of Operating Engineers, opposes the move toward national certification.</p>
<p>Individuals who operate small mobile cranes are already required to abide by these rules. The recent action by officials would extend the mandate to workers who operate tower and other types of cranes.</p>
<p>The new regulations take effect for new applicants on May 26. Those crane operators who are already licensed have until July 1, 2013 to come into compliance. License renewal is required every five years.</p>

        <![CDATA[<p>Commercial trucks barreling down the highway can pose a significant danger to motorists. The sheer size and weight of 18-wheelers, compared to average passenger vehicles, makes them much more likely to cause fatal motor vehicle accidents. In an effort to help prevent <a href="http://www.djhernandez.com/Car-Accidents/Truck-Accidents.shtml">truck accidents</a>, devices called speed limiters are now being installed on many semis. These devices govern the top speed a truck may travel.</p>
<p>New research provided to the Federal Motor Carrier Safety Administration (FMCSA) showed that speed limiters&nbsp;were effective at preventing speed-related truck crashes. The report indicated that those trucks with the devices had a collision rate for "speed limiter-relevant" crashes that was 50 percent lower than semis without speed limiters.</p>]]>
        <![CDATA[<p>Several factors were considered when determining whether a crash was speed limiter-relevant, including the applicable speed limit and crash type. Contributing factors like weather were also used to exclude some collisions.</p>
<p>The overall crash rate was also lower for trucks equipped with speed limiters compared to those without the devices.</p>
<p>The President of the American Trucking Associations (ATA) supported the findings of the report, "This study confirms what ATA has been saying for years- speed kills and one of the most effective ways to prevent hundreds, if not thousands, of crashes on our highways is to slow all vehicles down, including large trucks."</p>
<p>Regulators appear to be moving swiftly on issuing a rule that would require speed limiters on all heavy trucks, many of which are already equipped with the devices.</p>

Since a stricter law was passed this summer, 7, 495 tickets have been issued by law enforcement. This is up significantly from the 3,248 tickets given out during all of 2010.</p>
<p>Under the new law, <a href="http://www.djhernandez.com/Car-Accidents/Distracted-Driver-Accidents.shtml">texting while driving in New York</a> is considered a primary offense. This means drivers do not have to be violating another traffic regulation in order to be pulled over by police. Previously, texting while driving was a secondary offense where police needed an additional reason to stop motorists.</p>]]>
        <![CDATA[<p>In addition to the tickets issued for texting while driving, police gave out 111,262 citations since July for using mobile electronic devices while behind the wheel. Suffolk County had the greatest number of tickets issued to drivers talking on a cellphones with 5,355. Westchester County came in second with 4, 729.</p>
<p>Governor Cuomo released a statement indicating he was pleased with the enforcement efforts. "These tickets should send a resounding message to all drivers: keep your eyes on the road and your hands on the wheel."</p>
<p>New York currently has some of the toughest distracted driving laws in the country, but more states may be following suit. The National Transportation Safety Board (NTSB) recently called for a full nationwide ban on texting and talking on the phone while driving.</p>
<p>Hopefully stricter laws and tougher enforcement will lead to fewer distracted driving accidents in New York and across the country.</p>

        <![CDATA[<p>Two New York City area collisions last month resulted in the tragic deaths of two young boys, ages four and five. Prescription drug abuse is currently being investigated in connection with both crashes. According to New York Sen. Charles Schumer, these <a href="http://www.djhernandez.com/Car-Accidents/">New York car accidents</a> sparked in&nbsp;part&nbsp;his proposal to use federal funds, within a pending transportation bill, for research and police training related to drugged drivers.</p>
<p>The proposal was also brought forward by Arkansas Sen. Mark Pryor. Senators Schumer and Pryor claim police have little training and no equipment to identify drugged drivers, who often don't exhibit the same outward indicators of intoxication as drunk drivers.</p>
<p>In New York, drugged driving arrests have increased 35 percent since 2001. Sen. Schumer claims, however, that those caught only represent a fraction of the offenders.</p>]]>
        <![CDATA[<p>Over 15 percent of weekend and evening drivers had positive tests for illegal prescription or over-the-counter drugs, according to a 2007 survey by the National Highway Traffic Safety Administration (NHTSA). The same survey showed 11 percent of drivers had used illegal drugs. Additionally, the NHTSA found a third of the over 12,000 drivers tested who were killed in 2009 auto accidents had taken drugs.</p>
<p>"With the explosive growth of prescription drug abuse it's vital that local law enforcement have the tools and training they need to identify those driving under the influence of narcotics to get them off the road," explained Sen. Schumer.</p>
<p>The proposal includes the creation of federal grants to enable police to receive instruction in the detection of drugged driving.</p>

        <![CDATA[<p>Thousands of New Yorkers take elevators every day without a second thought. Some riders may occasionally worry about being temporarily stuck in an elevator, but hardly anyone considers the possibility that they could be physically injured. That may be changing. A series of recent <a href="http://www.djhernandez.com/Personal-Injury/Elevator-Injuries.shtml">New York elevator injuries</a> have recently made news as riders have been seriously injured and killed.</p>
<p>In Manhattan earlier this month, an elevator suddenly lurched upwards as a woman attempted to step into the elevator car. She became pinned between the wall of the elevator shaft and the car, suffering fatal injuries.</p>]]>
        <![CDATA[<p>Also this December, in Brooklyn a woman died inside an elevator car after she was sprayed with flammable liquid and a Molotov cocktail was used to set her on fire.</p>
<p>Finally, felony assault charges were filed this month against an elevator mechanic stemming from a December 2010 incident. In that accident a woman's leg became trapped between the elevator shaft and car. She was dragged for several floors resulting in most of her leg becoming mangled. The mechanic allegedly took a shortcut to fix the elevator prior to the accident.</p>
<p>These recent events have highlighted the potential dangers of elevators where riders can become trapped with no way to escape. An estimated 27 people in the U.S. die each year as the result of elevator accidents. Considering the roughly 18 billion trips elevators make per year such accidents are relatively rare. However, even one elevator accident fatality is too many.</p>

<p>While this may sound odd at first, the driving simulator has the lofty purpose of teaching teen drivers&nbsp;about the real dangers of <a href="http://www.djhernandez.com/Car-Accidents/Distracted-Driver-Accidents.shtml">distracted driving accidents</a>. While they simulate driving, they must navigate the road amidst the chatter, text while driving and place a phone call.</p>
<p>The results can be distressing. The driving simulator has led test subjects into pretend accidents that are designed to show them the very real dangers of distracted driving.</p>]]>
        <![CDATA[<p><strong>New York's Ban on Texting While Driving: Addressing the Dangers</strong></p>
<p>New York law recognizes the serious danger of texting while driving. Its ban on the practice recently made texting while driving a primary offense. This means that police officers may pull over drivers for texting while driving even if they are not committing another driving offense.</p>
<p>The consequences of a texting while driving offense in New York are a $150 fine and a three-point license penalty. Police officers have already issued numerous tickets.</p>
<p>While this may seem like a steep punishment, consider the habits of some drivers. Among drivers 30 years old and younger, 30 percent admitted to texting while driving, according to information released by Secretary of Transportation Ray LaHood.</p>
<p>With so many lives lost and so many people injured due to distracted driving, New York's recent approach to enforcement may help. The distracted driving simulator, too, may have an impact on when teens choose to send a text message, and when they choose to focus on the road.</p>

        <![CDATA[<p>Fifteen people died in a terrible bus accident in March of this year in the Bronx. The bus was owned and operated by World Wide Travel in Brooklyn. According to the <em>New York Times</em>, the Federal Motor Carrier Safety Administration (FMCSA) investigation of the <a href="http://www.djhernandez.com/Car-Accidents/Tour-Charter-Bus-Accidents.shtml">tour bus accident</a> turned up serious safety violations.</p>
<p>The company's driver had violated the "hours of service" regulations that govern how many hours a driver can stay on the road and how long they have to rest. The report showed the company routinely violated these regulations.</p>
<p>The driver of the fatal bus was indicted on manslaughter charges, and the FMCSA shut down World Wide Travel. But that is not the end of the story. World Wide Travel may have been closed, but the <em>Times</em> reports that buses and drivers were transferred to another Brooklyn company owned by the same person who owned World Wide Travel.</p>]]>
        <![CDATA[<p><strong>Regulations and Reincarnation</strong></p>
<p>The FMCSA can shut down a bus company for safety violations. The problem is often the business reappears weeks or months later with little more than a name change. This happens so frequently that in 2009 the Government Accountability Office (GAO) published a report after a bus accident in 2008 killed 17 in Sherman, Texas.</p>
<p>That report found nine percent of closed bus companies reopen as newly named entities. Twenty "out of service" carriers had "morphed" or "reincarnated" as differently named carriers.</p>
<p>Changing names is perfectly legal. It makes tracking dangerous carriers difficult, but there is nothing that prohibits a company from "going out of business" and then reappearing with a new name.</p>
<p>The FMCSA has limited resources to attempt to discover these rouge bus companies. Stricter enforcement will probably require additional regulations and more funding.</p>
<p>The Department of Transportation (DOT) noted in response to the report, sometimes companies transfer ownership for bona fide reasons, and detecting and proving a "reincarnation" done to avoid detection by authorities is labor-intensive and demands additional documentation beyond a normal compliance review.</p>

        <![CDATA[<p>Earlier this month, New York City experienced its tenth fatal bicycle accident. The 24-year-old Brooklyn man died after he ran a red light and was struck by an SUV.</p>
<p>According to Transportation Alternatives, the number of fatal bicycle-accidents appears to be on the decline in New York City. Last year, 18 bicyclists were killed in the city and just two years prior, in 2008, 26 bicyclists were killed.</p>
<p>The New York Daily News reported Transportation Alternatives Executive Director Paul Steely White as saying that in the last decade the number of <a href="http://www.djhernandez.com/Personal-Injury/">personal injuries</a> suffered by bicyclists has decreased, despite the fact that the number of bicyclists has increased.</p>]]>
        <![CDATA[<p><strong>Safe Bicycling Tips</strong></p>
<p>Because the laws of the state of New York treat bicycles like passenger vehicles, one of the surest ways that a bicycle rider can remain safe is to obey the rules of the road. By doing so, bicyclists travel in the same predictable manner as cars, increasing the chances that vehicle drivers will see and be able to predict which way that bicyclists will maneuver. According to information provided by New York City, bicyclists that ride predictably reduce their chances of being involved in an accident with a car.</p>
<p>There are other ways that bicyclists can protect themselves, and <a href="http://www.nyc.gov/html/dot/html/bicyclists/biketips.shtml" target="_blank">New York City</a> offers the following tips for safe riding:</p>
<ul>
<li>Wear a helmet </li>
<li>Wear bright colored clothing</li>
<li>Use reflectors and bike lights during dusk and nighttime hours</li>
<li>Be aware of surroundings, especially car doors</li>
<li>Always look before turning, and make sure drivers see you by establishing eye contact</li>
<li>Obey all traffic laws, especially stop signs and red lights</li>
<li>Ride in marked bike paths, when available</li>
<li>Only use one earphone of a portable music device</li></ul>

<p>The new app is called PhoneGuard. This free app shuts down most applications when it detects that the phone is moving more than ten miles per hour and displays a "No Texting Vehicle" message. Incoming calls can be received, but virtually every other function requiring keypad or touch entry is blocked.</p>]]>
        <![CDATA[<p><strong>Scope of the Problem of Distracted Driving</strong></p>
<p>According to distraction.gov (sponsored by the U.S. Department of Transportation), roughly one fifth of 2009's injury crashes involved reports of distracted driving. That's 5,474 deaths and 448,000 injuries in distracted driving motor vehicle accidents. And sadly, drivers under 20 made up the greatest proportion of distracted driving accidents that involved a fatality.</p>
<p>Studies show that drivers using a handheld device are four times more likely to suffer an injury in a crash. Moreover, talking on the phone (hands-free or not) delays reaction times as much as .08 percent blood alcohol levels, the drunk driving limit in most states.</p>
<p>The severity of the problem is not in doubt by most members of the public. However, many times, even when people are aware of these frightening statistics, the temptation to answer a text or get one more thing done overwhelms logic and safety. PhoneGuard removes the temptation by making it impossible to do these activities.</p>

<p>One witness to the <a href="http://www.djhernandez.com/Car-Accidents/New-York-Public-Transportation-Accidents.shtml"><strong>public transportation accident</strong></a> reported hearing a "boom" and then seeing bus passengers stumble off the bus as those in the nearby vicinity rushed to help. The 15 injured passengers were taken to a nearby hospital. Luckily none of the injuries were considered life-threatening.</p>]]>
        <![CDATA[<p><strong>Proper Safety Precautions on Buses</strong></p>
<p>Although it is not clear what caused the Bronx bus accident, this incident along with the recent series of other bus accidents in New York, highlight the need for bus drivers and passengers to be more vigilant about bus safety.</p>
<p>If you are a bus passenger the MTA suggests the following safety tips:</p>
<ul>
<li>Never lean against the rear door or stand in the stairwell/rear door step</li>
<li>Stay behind the white line at the front of the bus</li>
<li>If you are traveling with a stroller it should remain folded while on the bus</li>
<li>To ensure the bus operator has adequate time to stop smoothly, make sure you signal two blocks prior to your desired stop</li></ul>
<p>Although bus passengers cannot control if a bus driver makes a mistake causing a collision, they can take safety precautions themselves to help avoid potential bus accidents and injuries.</p>

In fact, such accidents are the leading cause of death for Americans ages 5-34. Approximately nine percent of those accidents involve commercial trucks, according to trucking.net.</p>
<p><strong>What is the FMCSA Strategic Plan?</strong></p>
<p>The Federal Motor Carrier Safety Association (FMCSA) was formed by the Department of Transportation (DOT) in January 2000, and charged with reducing crashes, injuries and fatalities involving commercial motor vehicles. Since its creation, the rate of US traffic fatalities involving commercial vehicles has fallen to the lowest level since 1975, the year the DOT began tracking data.</p>
<p>In an effort to make America's highways even safer and further decrease <a href="http://www.djhernandez.com/Car-Accidents/Truck-Accidents.shtml"><strong>truck accidents</strong></a>, the FMCSA, has drafted a three-part, five-year strategic plan. The details of this plan, titled "<a href="http://www.fmcsa.dot.gov/about/news/news-releases/2011/FMCSA-Strategic-Plan.aspx" target="_blank">Raising the Bar</a>," were released earlier this summer.</p>]]>
        <![CDATA[<p>The FMCSA plan seeks to impose more stringent requirements for entering the commercial motor vehicle industry, sets higher standards to continue in the industry, and seeks to eliminate high-risk carriers and drivers from the roads.</p>
<p><strong>Trucking Industry Response</strong></p>
<p>Still, many industry organizations feel that the FMCSA plan doesn't go far enough. While lauding the association's efforts, the American Trucking Associations (ATA) would like to see such a plan address passenger motorists as well as commercial carriers. By only focusing on just one side of the issue, the ATA feels the plan fails to address the cause of up to 70 percent of truck accidents, those caused by motorists in passenger vehicles.</p>

        <![CDATA[<p>Despite the economic downturn, recently a rather surprising statistic was announced, June ended with a decline in bankruptcy filings. This dip is welcomed news after a long stretch of the same old depressing economic downward spiral.</p>
<p>The drop in filed bankruptcies was a fairly impressive 6.2 percent drop from May, and an even better 10 percent decrease compared to June 2010. <strong><a href="http://www.djhernandez.com/Bankruptcy/">Bankruptcy</a> </strong>filings in New York were down five percent. These figures seem to offer a glimmer of hope; some may begin thinking things may finally be looking up for the economy. According to experts, however, this optimistic view may be a slight jump of the gun.</p>
<p>Experts point out that although factors like unemployment and foreclosures may impact the rate of bankruptcies, bankruptcy filings seem to be most closely tied to consumer credit and debt. Therefore what may be driving the decline in bankruptcies is the fact that Americans had less access to credit the past few years and thus less debt to discharge. Now consumers are being given more credit, so consumers can use this additional credit to get them through rough financial times. In sum, the fact that fewer Americans filed for bankruptcy does not necessarily provide evidence that the economy is any healthier.</p>]]>
        <![CDATA[<p><strong>Types of Bankruptcy</strong></p>
<p>Chapter 7 bankruptcies have made up the majority of bankruptcy filings this year, almost 70 percent. A Chapter 7 bankruptcy provides those buried in debt with a fresh financial start. This type of bankruptcy is contingent on qualification, as filers must prove through a means test that they are unable to meet their current debt burden.</p>
<p>A <strong><a href="http://www.djhernandez.com/Bankruptcy/Chapter-13.shtml">Chapter 13 bankruptcy</a></strong> essentially restructures debts into an affordable three to five year repayment plan. Chapter 13 bankruptcy can prevent the loss of homes to foreclosure, but requires the filer to honor portions of their debt over the course of time. A little less than 28 percent of bankruptcy filings this year fell under Chapter 13. Mostly commercial filings make up the remaining cases.</p>
<p>Declining bankruptcy filings, however, should allow for some optimism. Even if the drop in bankruptcies is a result of shifts in available consumer credit rather than an improving economy, at least it indicates that perhaps the debt burden of Americans is decreasing.</p>

        <![CDATA[<p>If you think bus travel is perfectly safe, think again. According to the Research and Innovative Technology Administration (the research arm of the U.S. Department of Transportation), there were a whopping 60,247 crashes involving buses in 2008. Those 60, 247 crashes resulted in 67 deaths and approximately 15,000 reported injuries.</p>
<p>Just such a <a href="http://www.djhernandez.com/Car-Accidents/Bus-Accidents.shtml"><strong>bus accident</strong></a> occurred in the early hours of June 27, 2011 when a tourist bus owned by Mr. Ho Charter Service slammed into the rear end of a tractor-trailer. The accident occurred on a Pennsylvania turnpike, while the bus was heading to New York.</p>
<p>The 39-year-old driver of New York City was killed. Twenty-three unsuspecting passengers were injured.</p>
<p>The Federal Motor Carrier Safety Administration (FMCSA) discovered that the charter bus company was currently in violation of several safety rules on top of having a record of safety offenses. It had failed to administer the required drug tests to either the driver or the co-driver. Both drivers had also falsified their driving logs to make it appear as if they had the required eight-hour rest breaks before driving again.</p>]]>
        <![CDATA[<p>Mr. Ho Charter Company had previously been cited for 12 "fatigued driver" incidents. Additionally on June 7, 2011, in a compliance review, FMCSA investigators found that the <a href="http://www.djhernandez.com/Car-Accidents/Tour-Charter-Bus-Accidents.shtml"><strong>charter bus company</strong></a> had not been conducting required drug and alcohol screenings of its drivers.</p>
<p>After the June 7 review, the company was cited and heavily fined. Still, Mr. Ho Charter Service continued to allow drivers to operate passenger-filled buses without proper rest or drug screenings. Finally, last month the FMCSA shut the bus company down, making it the second bus company the agency&nbsp;closed down in a 24 hour period.</p>
<p>Most of us assume that bus companies put the safety of their passengers first, and that bus drivers do too. But as is so often the case, the temptation to make as much money as quickly as possible, gets in the way. Unfortunately, when we see buses barreling down the highway, aiming for tourist towns and casinos, it is not always safe to assume that the person in the driver's seat is aware and alert.</p>

        <![CDATA[<p>The Automobile Association of America (AAA) is advocating for an immediate redesign of the Ed Koch Queensboro Bridge. Within a two month time span, there have been three serious <a href="http://www.djhernandez.com/Car-Accidents/Types-of-Auto-Accidents.shtml">auto accidents</a> on a dangerous ramp off the bridge with a hair-pin curve. One accident in late March resulted in the death of an innocent pedestrian.</p>
<p>Robert Sinclair, of AAA New York, stated, "It might, perhaps, take some sort of re-engineering of the roadway itself. It's a tricky maneuver, a so-called slalom maneuver. A vehicle has to make a right turn followed by a quick left."</p>
<p>The city's Department of Transportation has already taken some steps to improve safety on the ramp. Recently it installed white rumble strips, warnings signs, barricades and flashing lights in an attempt to alert drivers of the need to drive slowly and carefully. These measures, however, failed to prevent yet another crash last month.</p>]]>
        <![CDATA[<p>Maura McCarthy, DOT Queens Commissioner, urged drivers to slow down stating that speeding likely contributed to all three accidents. An anti-speeding campaign has also been launched by the city to increase driver awareness about the dangers of speeding.</p>
<p>Lack of proper lighting may also have been a factor since the three accidents all occurred between 4 and 5:30 a.m. The city will be doing further analysis of the accident-prone area in light of the most recent crash.</p>
<p>Hopefully officials will move quickly to make further safety improvements and prevent additional <a href="http://www.djhernandez.com/Car-Accidents/">car accidents</a>. Sinclair urges the city to "Act and act now."</p>
