How Does Chapter 7 Work?
Before we can help you file for Chapter 7, we must see if you can pass what is known as the "means test." If your household income is less than the median income in your state, you pass the means test. If your household income is greater than the median income, you may still be eligible for Chapter 7 bankruptcy, depending on your levels of disposable income. Assuming you pass the means test, our law firm will gather information about your assets and your debts and file for bankruptcy.
Once we file for bankruptcy, the "automatic stay" will begin. The automatic stay prevents your creditors and debt collection agencies from taking action against you. This will stop garnishments, lawsuits and collection letters and phone calls. Once the bankruptcy court approves your bankruptcy, your unsecured debts, such as credit cards and medical bills, will be discharged. Once your debts are discharged, your creditors can no longer try to collect them and you get a new lease on life.
Will I Be Able to Get Credit Again?
Many people believe that filing for bankruptcy will cause irreparable damage to their credit. This is not true. In fact, some credit card companies may find you to be a good risk, since you will be unable to file bankruptcy for some years after your discharge.
